I was talking with one of the persons Dmitry Kovalivnich scammed in regards to whether he will get his money back from PayPal. This person is from Canada.
When a scammer like Dmitry Kovalivnich stings someone in the USA the following occurs:
1- PayPal says: whoops…that payment you received is in dispute and places a hold on the money in your PayPal account
2- They tell you that while they investigate the hold will remain on the money
3- at the end of the maximum time period allowed by their rules ( or USA law? ) they announce they must revoke the payment.
It always happens that way if you are a seller in the USA. They use the time delay of point #3 to try to get you to cool down and forget you have been bilked.
When I talked with the seller from Canada he told me this:
I’ve never lost a dispute with Paypal before. I’ve had at least 5 or 6 as a seller and buyer. Sometimes, you need to do a little fighting with them, but eventually they always pay me back.
It’s even easier for me in Canada because I can use our extensive fraud & banking laws to my advantage when dealing with Paypal. It’s illegal in Canada (for Paypal or anyone else) to just take someone’s money away that you’ve already paid them. That’s a matter you can only settle through the civil legal system here.
Credit card charebacks are different here too thankfully: unless the merchant/store provides no evidence that they shipped the product/or that the customer was ever in the store, even if it’s a stolen card, the merchant is not responsible at all. It ends up being the Credit Card issuing bank that foots the bill.
